Our Litigation Department

Our Litigation Department is comprised of experienced lawyers specialising in local and international Commercial, Corporate and Civil Litigation.

We encourage disputes to be settled without the need for litigation, since extra-judicial dispute resolution saves untold time and expenses for our Clients. However, where court action appears to be the only option, our services fall into two main categories:-

  • We represent our Clients in Litigation matters before the various Municipal and Police Departments. At all stages we aim to ensure that Clients appreciate the implications of the proceedings and provide an understanding of the process so that Clients are full aware of their rights and obligations. 
     

  • For Litigation matters before the UAE and International Courts, we act as Principal and instruct local advocates or foreign lawyers to provide specialist advice, draft pleadings and represent our Clients before the Courts. We supervise the litigation, which includes dissemination, translation and compilation of our Clients’ documents; providing strategy and advice; ensuring reasonableness of fees and expenses of the local advocate or foreign lawyer; and providing full and regular progress reports to our Client.

We have strong associations with local advocates and have also developed litigation strategies for our Clients in various other countries, utilising specialised or smaller firms with reasonable fee structures.

Such associations exist with lawyers in England, Scotland, U.S.A., countries in Asia (particularly Hong Kong) and, of course, throughout the Middle East, including Iran.

We look for firms with a strong Litigation Department which can analyse the dispute and, based upon the Laws of their own jurisdiction, can provide us with a sound opinion on whether litigation or settlement should be pursued.

Specifically, we handle the following matters for our Clients:-

CIVIL SUITS

Pursuant to instructions, we would peruse documentation in order to provide a legal opinion on the merits of the cases.  We would liaise closely with advocates based in the UAE and elsewhere as required. 

We assist our Clients to assess both the costs and the legal merits of pursuing the cases and, if our Clients so desire, we would proceed, bearing in mind the provision of quality supervision in the interests of ensuring a successful outcome to the best of our abilities. 

Our brief would entail monitoring of cases, careful scrutiny of all pleadings drafted by the advocates, arranging translation of pleadings, full reporting of progress of the cases to Clients and convening regular meetings with the advocates to keep abreast of the cases.  Back to Top

PARALLEL IMPORTS & COUNTERFEITS

We have an acknowledged reputation in this specialist area, working closely with the relevant Municipal departments, Ministries and Police Departments.  We have successfully combated parallel imports in the area of motor vehicles, watches, luxury goods and other products.  Back to Top

MARINE

We handle maritime disputes, including arrests of ships through advocates in all the Emirates of the U.A.E. to secure expeditious recovery of debt or related matters.  Back to Top

CRIMINAL CASES, RENT AND LABOUR DISPUTES

We would handle Criminal Cases on a case-by-case basis for our Corporate clients, for example, pursuing dishonoured cheques cases, defending misdemeanours.  In this regard, we may deal directly with the Police Departments and the office of Public Prosecution.

In respect of Rent Disputes, we have time and again represented our Clients directly at the Dubai Municipality, however attempting initially to achieve results through amicable resolutions.

Labour Disputes arise in the UAE and we would formulate strategies with our Clients either to file or defend complaints at the Ministry of Labour.  This would entail compilation and translation of documents, with an accompanying Letter explaining the merits of our Clients’ cases in full.  From time to time, certain cases would be transferred to Courts, and in this regard, please see In the News.  Back to Top
