INTRODUCTION
 

Our Property Department comprises of experienced lawyers specialising in providing quality legal advice with respect to various aspects of the ever-changing property market in Dubai. 

Since the introduction of Law No. 7 of 2006 (“Dubai Property Law”) in March 2006, certain areas of the property sector in Dubai has been clarified, specifically the issues surrounding the definitions of freehold and leasehold of property, registration of title etc. and we advise our clients accordingly.

We have also given numerous talks with respect to property law and the implications thereof, including workshops for real estate agents, presentation at the Property Special Interest Group, which form part of the British Business Group, etc.

We assist our clients in providing the following services:

1. MOAs: We review, draft and/or advise Memoranda of Agreement or Agreements for Sale for the resale of property; 

2. Developers’ Agreements: As most Developers’ Agreements are non-negotiable we review these documents and advise clients of possible pitfalls they should be aware of and the implication of certain clauses;

3. POAs: We prepare Powers of Attorney for clients who want to appoint an attorney to act on their behalf and also act as attorney for clients who are not residing in Dubai and do not wish to come to Dubai to do the Property transfer;

4. Emirates Hills: As property in Emirates Hills cannot be sold until the construction on the property has been completed, we have devised a number of security methods to ensure that buyers of such property are adequately protected in the event the seller defaults prior to completion;

5. Developers: We also assist certain developers in preparing their documentation, i.e. Sale and Purchase Agreements, Constitution of the Owners Association etc.; and

6. Residence visas: We assist clients who had purchased property from Emaar in obtaining their residence visas in accordance with Emaar procedures; and

7. Advising clients with respect to the new Dubai Property Law and all matters relating to property.
                       

PROPERTY UPDATES

It is interesting to note that for all Property Owners, you are now taxed each month for Dubai Municipality Charges as follows :

Value of the Property as purchased x 10% x 5%

This is a levy which is basically their assessment of a nominal rental amount payable by all Expatriates.
